Smart contracts: Transparency or double discrimination?

The incorporation of blockchain-based technologies in contractual relations has inaugurated a new phase of contractuality, marked by automation, decentralization, and increasing algorithmic intermediation. In this scenario, although smart contracts promise efficiency, security, and cost reduction, they bring ethical and legal challenges that put the principle of contractual balance at risk, especially in the face of the marked vulnerability of marginalized groups and individuals in the information society. This article examines the relationship between blockchain technology, smart contracts, and algorithmic discrimination. In addition, it analyzes how algorithmic justice and the right to difference offer new parameters for reflection on structural inequalities reproduced by decentralized digital systems mediated by artificial intelligences. In it, based on a practical example involving DeFi platforms, it is discussed to what extent automated digital structures can create access barriers and perpetuate discriminatory biases, especially under the paradigm that code is law. This is a qualitative study, developed through the hypothetical-deductive method, using a review of selected bibliography, interdisciplinary doctrine and jurisprudence, as well as a case study.
