Abstract

O presente artigo insere-se na idéia de estipular uma forma mais criteriosa de fiscalização contra a violação das normas constitucionais, bem como analisar a necessidade de controle das atividades desempenhadas pelos legisladores por meio da vinculação ao texto constitucional, assegurando, assim, impedir a ilegítima tomada de poder. Desta forma, como vértice do sistema e com a missão de fazer cumprir e respeitar os preceitos previstos constitucionalmente, atribui-se vertente democrática e legitimadora à Justiça Constitucional, que com sua função de manter a supremacia da Constituição, a defesa e a promoção dos direitos fundamentais, atua garantindo por meio deste expediente a preservação e o resguardo das idéias básicas de um Estado Democrático de Direito.

Possui especialização em Direito Público pela Faculdade Mater Dei (Pato Branco-PR).Graduada em Ciências Jurídicas e Sociais pela Universidade do Vale do Rio dos Sinos - Unisinos (São Leopoldo-RS).
