“Sobrevivendo no inferno”: The drug law as a reflection of racism in brazilian criminal law

This study aims, from the perspective of the work "Sobrevivendo no Inferno" (Sobrevivendo no Inferno) by Racionais MC's, to analyze the lack of distinguishing criteria between users and traffickers in Law 11.343/2006, as a reflection of racism in Brazilian criminal law. To this end, the chosen method is deductive, based on bibliographic and documentary research. Based on the premise that every young Black Brazilian is a victim of structural racism and, therefore, framed within the racist stereotype of a criminal, this social interpretation is reinforced by the fact that the Drug Law does not establish objective criteria for distinguishing users from traffickers. This reality will be illustrated by songs from the album "Sobrevivendo no Inferno" (Sobrevivendo no Inferno) by Racionais MC's. The conclusion is that the Drug Law reveals itself to be purposefully silent as a consequence of an implicit legislative option in the adoption of enemy criminal law, with Black people being the components of the population group reduced to a social enemy.
