On-Line Conflict Resolution Platforms: New Sustainable Paradigms For The “Disjudicialization” Of Litigations In Brazil

This paper aims to outline the methods of conflict resolution existing in Brazil, starting from a historical analysis of the means used to solve social demands, up to the discussion of the great current problem, which is the increased demand by the Judiciary. The research presents alternative means of resolving conflicts that have been encouraged by national legislation, in addition to demonstrating the need to implement public policies with a focus on “dejudicialization” demands. Thus, theoretical-legal methodology was used with deductive reasoning through doctrinal and jurisprudential analysis. The article discusses measures for “dejudicialization” through the use of the virtual environment, presenting private Online Dispute Resolution (ODR) initiatives, which promote mediation, negotiation, conciliation and arbitration, and the governmental consumer platform, focused on resolution consumer conflicts.
