ENSINO JURÍDICO COMO CONDIÇÃO DE POSSIBILIDADE A COMPREENSÃO (CONSTITUCIONAL) DO DIREITO

O estudo do ensino jurídico como condição de possibilidade para a compreensão (constitucional) do direito se revela de vital importância não só aos ora pesquisadores, proponentes do presente trabalho, como, também, a sociedade em sentido latu. É somente por meio da análise dos conceitos de Estado, Direito e Democracia, que a inefetividade do Positivismo Jurídico, para responder aos anseios da sociedade e realização de uma Justiça ética em prol da inclusão social e do exercício da cidadania, é revelada. A partir disso, o presente artigo tem por fundamento, destacar a necessária mudança de paradigma do ensino jurídico como condição de possibilidade para, assim, chegar-se à construção de uma nova ordem social, mais justa, digna e sem utopias devoradoras, que unicamente geram genocidas processos de exclusão social. Desenvolvido por meio teórico, com ênfase na bibliografia indicada e na Constituição Federal de 1988, a pesquisa, como se verá, revela-se em relação aos objetivos dialética e quanto ao método de abordagem dedutiva.
