DA CONVERGÊNCIA E COMPLEMENTARIDADE DO DIREITO DA CONCORRÊNCIA E A REGULAÇÃO DO SETOR PORTUÁRIO

Na qualidade de princípio da ordem econômica, a livre concorrência deve ser aplicada a todos os setores da economia, não havendo restrição expressa a sua aplicação no ramo portuário. Existe, no entanto, uma convergência entre a atuação dos entes do sistema de defesa da concorrência e das agências reguladoras, sendo evidente o risco de posturas contraditórias e prejudiciais a certas políticas públicas. Fundamental, dessa forma, se pensar em soluções capazes de harmonizar o ideal de defesa da concorrência e a independência entre os poderes da nação.
