RETHINKING DEMOCRACY
A GUARANTEE CRITICISM TO THE CURRENT CONFIGURATION OF THE RULE OF LAW

The objective of this article is to analyze the guaranteeist critique of the current configuration of the constitutional state. In its development, inconsistencies of the formal and substantial dimensions of democracy are presented, as well as the solutions suggested by the Italian theorist, Luigi Ferrajoli, to overcome them. It concludes by the need for a structural resizing of the rule of law, under the following premises: a) limitation to deregulated public / private powers; b) strengthening of political parties as independent representation bodies; c) reform of Montesquieu's tripartite theory; and d) strengthening and expanding the area of influence of the four basic guarantee postulates. For this purpose, using a qualitative approach, the bibliographic method is used, with research carried out on books, theses and academic articles published in prestigious journals.
