No presente artigo pretende-se trazer uma luz à discussão da efetivação dos direitos sociofundamentais a partir do acesso à terra. Para tanto, explanar-se-á brevemente sobre quais os sujeitos que no decorrer da história foram excluídos do acesso à terra. A partir dessa construção, tratar-se-á dos primeiros movimentos sociais do campo e de seu embate pela questão agrária no Brasil, com especial ênfase no MST, como novo ator social nesse processo de inclusão. Posteriormente, passar-se-á a analisar como o aparato jurídico estatal tem se constituído num entrave para os sujeitos que lutam pela efetivação dos direitos sociofundamentais a partir do acesso à terra.
