Abstract

 Este texto tem por objetivo situar a lei constitucional no plano do conhecimento enquanto catalisadora do acesso à Justiça, mediante analogia à dimensão do sagrado, compreendido dentro da ideia de Agamben. O pressuposto norteador do texto, à medida que relaciona a lei constitucional ao conceito de profanação, é que, em se rompendo com a mitologia que cerca o constitucionalismo em geral, visto como o templo que salvaguarda os princípios e normas do Estado de Direito, se desenvolve, paralelamente, um aumento do saber-sobre-o-Direito e, sobretudo, um acesso maior à Justiça.
