O DIREITO HUMANO À ÁGUA E JUSTIÇA AMBIENTAL: UMA ANÁLISE NORMATIVA DO PLANO INTERNACIONAL E A SITUAÇÃO BRASILEIRA

Abstract

Tomando em consideração as recentes inovações ocorridas no plano internacional com o reconhecimento da água como direito humana pela Assembleia Geral da ONU, e as recentes inovações ocorridas na legislação brasileira sobre o tema, esse artigo objetiva discutir as evoluções normativas no âmbito do direito à água no Brasil e no mundo e a situação brasileira de implementação dessa política pública pautado na perspectiva de justiça ambiental. Para tanto, o artigo divide-se em três partes: na primeira faz-se uma abordagem do reconhecimento da água como direito humano; na segunda aborda-se a legislação doméstica e na terceira trata da situação e dos desafios para a efetivação da política pública de recursos hídricos no Brasil.

Acadêmico de Direito da Fundação Universidade Regional de Blumenau, FURB. Pesquisador e Monitor do Núcleo de Estudos em Constitucionalismo, Internacionalização e Cooperação Internacional, CONSTINTER (FURB). Pesquisador do grupo de pesquisa Direitos fundamentais, cidadania e novos direitos (FURB). Pesquisador e Monitor da Academia Brasileira de Direito Constitucional (ABDConst) no projeto "o patrimônio comum do constitucionalismo democrático e a contribuição da América Latina". Realizou pesquisa no projeto Rede Guarani/Serra Geral (2012/2014). Possui formação continuada em Desenvolvimento Regional pelo Programa de Educação Superior para o Desenvolvimento Regional (PROESDE - FURB, PPGDR).
