Abstract

O presente artigo analisará a situação do policial militar como agente público e detentor do poder de polícia para o exercício de suas atividades de polícia ostensiva para a preservação da ordem pública e sua decorrente responsabilidade civil pela prática de delitos em que possa causar danos a terceiros. Também analisará a possibilidade de o Estado utilizar-se da ação de regresso, conforme previsto na Constituição Federal de 1988, sempre que se constatar que o dano a particular se deu em decorrência de conduta abusiva ou excessiva de policial militar, busca ressarcir-se dos pagamentos e aciona o direito de regresso contra o policial militar gerador do dano. Ainda, será trazido à baila as excludentes de responsabilidade civil e a pertinência ou não de fazer a denunciação da lide ao policial militar envolvido no dano cometido.
