The reasoning of judicial decisions in the civil procedure code: an analysis in Castanheira Neves about the importance of concrete cases in realizing law

This paper analyzes if the article 489, § 1, of the brazilian Civil Procedure Code, is compatible with the doctrine of Castanheira Neves. Try to find out if the lessons of the referenced author can assist in the application of the article 489. It verifies how judges of Brazilian Courts are evaluating the application of the mentioned legal provision.
