This article is located in the field of study on the erosion of fundamental social rights and neoliberal restructuring of labor, focusing on its effects on public regulation of teacher’s labor. The research problem is delimited by examining the compatibility between the restructuring of teaching activity and the constitutional statute of academic freedom, as part of a broader study on espoliative contractualities within the scope of Private Higher Education Institutions. Through a bibliographic and documentary study on the academic freedom in the Federal Constitution (section 1) and analysis of the problems of recording classes and the division of labor proposed in distance learnig (section 2), it was verified that there is a process of expropriation of personality attributes of teachers. The investigation process has a qualitative and exploratory purpose, using bibliographic review and legal documents analysis methods.
