Flexibilization of human rights? (In)compatibilities of labor flexibilization in Brazil with the right to decent conditions of work

Abstract

The article aims to subsidize the debate on the role human rights can play to the protection of workers' dignity in the face of labor flexibilization, boosted by globalization. It analyzes whether the right to just and favorable working conditions, provided for by art. 7 of the International Covenant on Economic, Social and Cultural Rights (ICESCR), constitutes a normative limitation for the flexibilization measures adopted by Brazil from the 1990s until the advent of Law n. 13.47/2017, highlighting the compatibilities and incompatibilities between them both. The article argues that, in order to answer this question, it must be considered that, similarly to labor law, the international human rights system has also been permeated by the influence of globalization. This happened through the reinterpretation of art. 7 of the ICESCR, carried out by the Committee on Economic, Social and Cultural Rights, who, moving away from the original meaning of this provision, began to understand it in a way delimited by the explicit terms of its wording. The article demonstrates that this understanding makes it possible that several elements of labor flexibility in Brazil be considered compatible with the right to just and favorable conditions of work, and that, therefore, human rights constitute a limited instrument for the workers’ protection. Grounded on critical works on globalization of the areas of international law and labor law, the research has qualitative nature, and it possesses a hypothetical-deductive approach and a historical and empirical procedure, being based on bibliographic materials, legislation, treaties, government reports, statements and Committee documents.
