The possible recognition of supral legality status to international environmental treaties: analysis of ADPF nº 708

Brazil is a signatory to 16 relevant multilateral environmental treaties/agreements, such as the Framework Convention on Climate Change and the Framework Convention on Biodiversity of the 1992 Rio Conference and the 2015 Paris Agreement, in addition to having a Constitution and an infraconstitutional legislation in line with international assumptions about the protection of the environment. The present study seeks to carry out an analysis on the possible recognition of supralegality in international treaties on environmental matters from ADPF nº 708, recognizing that the Brazilian Supreme Court has already recognized such status for judgments on matters of Human Rights, such as the Extraordinary Appeal nº . 466,343. The hypothetical-deductive method and literature review were used.
The results achieved confirm the possibility of declaring the supralegality of international treaties based on the judgment of ADPF nº 708, reinforcing that there is no conflict between the decision and the constitutional provisions. In conclusion, international treaties, conventions and pacts on the environment have a hierarchical status (supralegal) lower than the Constitution, but higher than ordinary legislation.
