A Eficácia da Lei Brasileira na Proteção de Ecossistemas como Requisito para Conservação da Diversidade Biológica

Este trabalho pretende analisar a importância da proteção dos ecossistemas nacionais como
conditio sine qua non para a conservação da diversidade biológica nacional. Da análise teórica do tema, partindo-se dos conceitos legais conferidos a sua nomenclatura-chave (diversidade biológica, ecossistemas e conservação), chega-se a uma abordagem da legislação ambiental brasileira, com destaque ao Código Florestal, no intuito de verificar a eficácia da norma jurídica dentro deste processo. Será a legislação capaz de proteger os ecossistemas e, assim, garantir a conservação da diversidade biológica no Brasil? Diante da amplitude do assunto e da riqueza dos biomas nacionais (florestas – Mata Atlântica e Amazônia –, cerrado, caatinga, etc), o tema será enfocado sob o ponto de vista da conservação das florestas nacionais, contrapondo as suas necessidades à proteção que lhes dispensa a legislação nacional, notadamente o Código Florestal (Lei n 4.771, de 15 de setembro de 1995).Downloads
